Barcelona Secure Major Legal Victory
FC Barcelona have received a significant boost off the pitch after a Spanish court dismissed a €3 million lawsuit linked to the transfer of Jules Koundé.
The case, which had been ongoing for months, was brought forward by FIFA-licensed agent Isaac Tutumlu, who claimed he was owed a commission for his role in facilitating the defender’s move from Sevilla FC in 2022.
However, the court has now ruled fully in Barcelona’s favor, bringing an emphatic end to the dispute.
The €3 Million Dispute Explained
The lawsuit revolved around a claim of approximately €3 million—around 6% of Koundé’s €50 million transfer fee.
Tutumlu argued that he had been directly instructed by Barcelona president Joan Laporta to act as an intermediary during negotiations. According to his claim, he used his relationship with Monchi, Sevilla’s then sporting director, to help guide the deal in Barcelona’s favor.
The agent also suggested he played a key role in influencing the player’s decision, especially amid strong interest from Chelsea FC, who were also pushing to sign the French defender at the time.
Barcelona’s Firm Defence
Throughout the proceedings, Barcelona maintained a clear and consistent stance: no formal agreement or mandate had ever been given to Tutumlu.
While the agent presented WhatsApp messages and records of meetings with former sporting director Mateu Alemany and then-manager Xavi Hernandez, the club argued that these interactions did not legally amount to an official contract or commission agreement.
Barcelona’s legal team emphasized that informal discussions or contacts cannot be interpreted as binding agreements—an argument that ultimately proved decisive in court.
Court Ruling: Case Dismissed Completely
The ruling, delivered by Judge Yolanda Lucía Arrieta of the Barcelona Court of First Instance, decisively rejected Tutumlu’s claims.
Not only was the €3 million demand dismissed in full, but the court also ordered the agent to cover the legal costs incurred during the trial. This outcome represents both a financial and reputational victory for Barcelona.
For a club that has faced financial scrutiny in recent years, avoiding such a payout is particularly significant.
